Fort Lauderdale Boat Show - Atlantis Giveaway

NO PURCHASE NECESSARY IN ORDER TO ENTER OR WIN THE GIVEAWAY.  Purchase will not increase your chances to win.  Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of Island Hotel Company Limited (the “Sponsor”) as final in all matters relating to this Giveaway.

Eligibility:  Giveaway is open from October 25, 2023 (10:00 am EST) - October 29, 2023 (7:00 pm EST ) to legal U.S. residents who are 18 years of age or older at the time of entry.  Employees of Island Hotel Company Limited, Paradise Enterprises Limited and BREF Bahamas Management, LLC and their respective affiliates, and their immediate families (spouse, domestic partner, parents, children and siblings and their respective spouses/domestic partners) and individuals living in the same households, whether related or not, are ineligible. Void where prohibited by law.

Sweepstakes Period:  Giveaway begins on October 25, 2023 (10:00 am EST) and ends on October 29, 2023 (7:00 pm EST). 

How to Enter: 

Entry to win is only available by scanning the QR code, which will direct participants to a form, which will require participants first and last name and e-mail address to enter.  Participants will also be required to acknowledge that they are at least 18 years of age and that they have read and agree to these Official Rules. The maximum number of entries per person is one.  Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries.

The Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by the Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof.  If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to modify or suspend the Giveaway. 

Winner Selection/Odds: The prize winner will be selected by Sponsor in a random drawing on or about November 3, 2023 from among all eligible entries received. The drawing will be conducted by the Sponsor, whose decisions are final in all matters relating to the Giveaway. The actual odds of winning will depend upon the total number of actual eligible entries received during the sweepstakes period.

Prize:  One (1) prize will be awarded during the Giveaway period.  The prize along with the approximate retail value (“ARV”) or actual value are as follows: 

·         4 Day/3 Night Stay at The Royal for 2 guests, located at the Atlantis Paradise Island Bahamas (“Atlantis”) (ARV $2,200)

·         Dining Credit of $500 at Atlantis

·         Atlantis Dolphin Cay Experience for 2 (ARV $500)

·         Round Trip Airport Transfers between Nassau Lynden Pindling International Airport and The Royal at the Atlantis (ARV $200)

Total ARV of prize is $3,400, which includes VAT, levies, resort fees and mandatory gratuities. 

Note: Airfare is not included.  Booking of Atlantis hotel nights and Dolphin Cay Experiences are subject to availability and blackout dates determined by the Sponsor.

The winner will be required to furnish the Atlantis with a credit card guarantee on check-in and at check-out the winner will be required to settle their account in full for any extras/incidentals charged to their room pursuant to the Atlantis’ policies.

IMPORTANT NOTICE:  During the guest registration process, the winner and travel companion will be asked to sign a form agreeing to the following terms related to any claims they may have as a result of their stay at the Atlantis:  I agree that any claim I may have the Resort Parties resulting from any events occurring in The Bahamas shall be governed by and construed in accordance with the laws of the Commonwealth of The Bahamas, and further, irrevocably agree to the Supreme Court of The Bahamas as the exclusive venue for any such proceedings whatsoever. The foregoing shall apply to all persons accompanying me, and I represent that I have the authority to sign this document on their behalf.  The “Resort Parties” are Island Hotel Company Limited, Brookfield Hospitality Properties LLC, BREF Bahamas, Ltd, Atlantis Holdings (Bahamas) Limited, Paradise Island Holdings Limited, Paradise Island Limited and Paradise Enterprises Limited, Residences at Atlantis Development Limited, Harborside at Atlantis Development Limited and Harborside at Atlantis Management Limited, along with their parent, related and affiliated companies at every tier, and the officers, directors, employees, agents, representatives, successors and assigns of each of the foregoing entities.

The prize is non-transferable and must be used by October 29, 2024, and no substitutions are allowed, except by the Sponsor which reserves the right to substitute a prize of equal value. If the actual value of any prize turns out to be less than the stated ARV, the difference will not be awarded in cash.  Prizes have no cash value and if the winner is unable to redeem the package by October 29, 2024, the prize will be forfeited. Prize does not include transportation (air or other modes of transport) to/from The Bahamas.  Winner and their travel companion are responsible for ensuring they meet the requirements of entry into The Bahamas, including, but not limited to, a valid passport/visa, if applicable. The winner and travel companion must obey all local laws in regard to lodging restrictions. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to; ground transportation, airfare, personal charges at lodging, telecommunication charges, security fees, island departure taxes, specialty dining, tours & excursions, inter-island transportation, or other expenses or incidentals are not included and are the responsibility solely of the winner.  The winner is responsible for all taxes and fees associated with prize receipt and/or use.  The winning prize is provided “AS-IS” and the sponsor provides no warranty. 

Prize Notification: The one (1) winner will be notified by email, based upon available contact information provided at the time of entry. The winner will have 14 days to claim the prize after notification. The prize will be made available by contacting Sponsor. If the Sponsor is not able to contact a prize winner for any reason, the prize will be forfeited and awarded to an alternate winner. Winner is solely responsible for any applicable income or other taxes the individual may owe on the prize. By accepting a prize, the winner consents to the use of their name and likeness for publicity purposes without further compensation, unless otherwise prohibited by law.  The winner's travel companion must also execute liability/publicity releases prior to travel. Sponsor reserves the right to verify identity of winner by requesting identification that matches contact information provided at the time of entry.

Winner: For the name of the winner, available on or about November 3, 2023, send a self-addressed stamped envelope by November 30, 2023, referencing the Fort Lauderdale Boat Show - Atlantis Giveaway, to: Brookfield Hospitality Properties, LLC, Attention: General Counsel, 1000 S. Pine Island Rd., Suite 800, Plantation, FL  33324. These Official Rules will be available on the www.atlantisbahamas.com website during the Sweepstakes Period. 

General Conditions: These Official Rules shall be interpreted exclusively in accordance with Florida law. All entrants agree to release, indemnify, and hold Island Hotel Company LTD, Paradise Enterprises LTD and Brookfield Hospitality Properties LLC, along with their parent, subsidiary and affiliated companies at every tier, and their respective officers, directors, employees, agents and representatives from any and all claims of any kind arising directly or indirectly from the Giveaway, from any Giveaway prize, or from any publicity about the Giveaway. Released parties do not have any responsibility or liability whatsoever for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, printing, typographical, human or other errors, including, without limitation, the award of the prizes, the processing of entries or in any Giveaway related materials; for entries or signups that are corrupted, misdirected, incomplete, lost, stolen, late, undelivered, delayed, garbled, damaged, illegible or postage due; for transactions or entries that fail to enter into the processing system, or are reported or transmitted late or incorrectly or are lost for any reason. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules. If in the Sponsor's opinion, there is any suspected or actual evidence of tampering or corruption or if the Giveaway is compromised by virus, bugs, or any unauthorized human intervention, or any other causes beyond the control of the Sponsor and it is not capable of running as planned, Sponsor reserves the right to modify or suspend the Sweepstakes and conduct a random drawing to award the prize using all eligible non-suspect entries received as of the new drawing date if modified by Sponsor. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and shall not include any punitive, consequential or other damages, including costs associated with entering the Giveaway and in no event include attorneys' fees and winner hereby waive all rights to have damages multiplied or otherwise increased. Any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, or any prizes awarded, shall be resolved individually, without resort to any form of class action. All dispute resolution shall be made by the Sponsor in their sole discretion.

Data Collection: Information provided is subject to Atlantis’ Privacy Policy found at: https://www.atlantisbahamas/privacy.  By providing your information, you are giving consent (i) to share your name if you are selected as the winner of this Giveaway as may be required by applicable law; and (ii) for Sponsor to send you future Atlantis marketing materials.  Giveaway participants can opt-out of Atlantis marketing emails at any time in accordance with the Atlantis Privacy Policy.
